Trespassing comes in two degrees.  Criminal Trespass 1° is a gross misdemeanor which means the maximum penalty is 354 days in jail and a $5,000 fine.  Trespassing in the 1° is when you knowingly enter or remain unlawfully in a building.  A common example might be when you are ejected from Casino for being disruptive and refuse to leave or returns at a later date without permission.

Criminal Trespass 2° is a misdemeanor which means the maximum penalty is 90 days in jail and a $1,000. Criminal Trespass 2° is knowingly enters or remains unlawfully in or upon premises of another under circumstances not constituting criminal trespass 1°.  So if you went onto someone’s land unlawfully but not into a building, then you could be charged with Criminal Trespass 2°.
